Relevant legislation for acquisition and/or compensation

Land Acquisition    Land Admin Act The brochure from the DPI which describes the process of acquisition of land for public purposes. Also attached is the relevant section of the Land and Administration Act 1997.

The provisions of the Planning and Development Act 2005

Describes the City's obligations as the "responsible authority" in relation to Local Planning Scheme 17. Part 11 deals with compensation and acquisition of land defined by a planning scheme.

The Australian Property Institute published an informative article on the interpretation of this part in their newsletter dated 2006

Caversham Naming Albion

Area C to “Brabham”

Caversham Airbase area named. 1 May 2011, the Minister for Lands at a ceremony on the old race track with Sir Jack Brabham in attendance named the locality Brabham.

Text Box: This response is typical of the many received against the Proposed Convert Venue in West Swan

I find it astounding as a resident that it is even a consideration that another concert venue is being planned for this area… We live north of Reid Hwy and the noise from the Sandalford Winery concerts are unbelievable. In fact when we put our kids to bed, its like there is a stereo in their rooms and that is not an exaggeration. You need to hear it to believe it, and there is nothing we can do to stifle the noise. We have a 2 year old and a 4 month old and you can only imagine the difficulty we have getting them to sleep when Sandalford have these concerts. The decibel levels have been increased there when they should be turned down. It is hard to fathom why it needs to be so load.

And now there is a development application for a new Amphitheatre on West Swan Road. Now we will cop it from both ends and this is totally unacceptable. There are so many hard working business people in this area that keep this area alive and generate enormous income for the area. They are the ones who need to be looked after, not constantly hounded by shires who seem intent on making life difficult for them. Yet when the big boys want things like these amphitheatres approved we are all supposed to just embrace it. We put up with excessive aircraft noise that is unavoidable. This we accept as we don’t expect the planes to hover downward to the airport. But to have the Sandalford concerts AND NOW another venue on the opposite side of Reid Highway is comical. Have the shire seen the chaotic traffic dramas when Sandalford have these shows ?? It took me 45 minutes to travel 1km back to my home after a 12 hour shift and that is not a one-off situation. The area does not have anywhere near the logistic planning to stage these shows, yet shires don’t see or comprehend any of it. It is typical of any planning here in WA where everything is don’t with little or no insight, and always over budget.

You asked for our opinion and this is it. We are against it and do not want it to go ahead for the above reasons. These reasons are genuine in its direct effects on us.
